Operating on behalf of the SEM Committee, the Utility Regulator (UR) has served two provisional orders on EP NI Energy Ltd (EPNIE). The provisional orders were made in accordance with Article 42 of the Energy (Northern Ireland) Order 2003 as it appeared that EPNIE was likely to contravene its electricity generation licence (the Licence), granted by the UR. The first provisional order involves Conditions 4 and 14 of the Licence and the EPNIE’s compliance with the Grid Code and Trading and Settlement Code. The second provisional order involves Condition 17 of the Licence and a likely failure to comply with directions issued by the UR under that condition. The provisional orders came into effect at 18:00 on 24 September 2025 and will lapse on 18:00 hours on 23 December 2025 unless confirmed by the UR.
As required under Article 62(1)(f) and (2) of the Energy Order, the notices below detail the UR’s reasons for its decision to make the provisional orders.
